Effective 23 September 2026. These Terms of Use are the contract for PhotoCocoon.
By creating an account in the iPhone app, or by using photococoon.com, you agree to these terms. If you do not agree, do not use the service. The website is information. Accounts, payment, and coupons start in the iPhone app.
1. The service
PhotoCocoon backs up photos and videos from your iPhone at original quality, on Wi‑Fi, in the background, and restores them — with the dates they were taken — onto a phone that can receive them. It is not a social network, not a feed, not a compressed cousin of the camera roll.
Two sizes. Same engine. $12 per year for 100 GB. $20 per year for 1 TB. Paid in the iPhone app. A coupon, if you have one, is entered in the app.
We may offer a trial so you can see backup work before a store purchase exists. Trial still counts as an account under these terms.
2. Who may use it
You must be old enough to form a contract where you live, and at least 13. You must have the right to upload what you upload — your photos, or photos you are allowed to back up. Do not open an account for someone else without their say-so.
3. Your account
Sign-in is an email you control, completed in the app. Keep that inbox. You are responsible for activity on the account. Tell us if you lose the email. We may refuse or close an account that looks automated, abusive, or unlawful.
4. Your content
You keep ownership of your photos and videos. You grant PhotoCocoon a limited licence to store, copy, transmit, and restore those files solely to provide the service — including safety review that the law requires of hosts, encryption at rest, and moving bytes to S3-compatible storage we operate.
That licence ends when we finish deleting the account, except for copies we must keep by law or that remain for a short time in system backups that then expire.
We do not claim a right to publish your library, sell it, or train a model on it.
5. Acceptable use
Use PhotoCocoon to back up a camera roll you are allowed to keep. Do not use it to:
- store or share child sexual abuse material, or anything else illegal where you or we operate;
- attack, scan, or overload the service;
- resell the service as if it were yours;
- upload malware or content you do not have rights to.
We may disable an account that breaks this. We report illegal content as required. We do not send a courtesy email on a match. Safety.
6. Plans, quota, and payment
The plan size is a hard cap: 100 GB or 1 TB as you chose. Over that, new uploads are refused until you free space or change plan. Payment, when billed through Apple, follows Apple’s terms, including refunds and “Report a Problem.” Coupons only change what the app already allows.
If a paid plan lapses, we still let you read and download for a time. We do not hold the library hostage. We may later delete files for an account that stays unused and unpaid — we will say so in the app or by email first if we have an address that still works.
7. How well it works
Backup needs Wi‑Fi, Photos permission, and originals on the phone. If iCloud Optimize has already evicted the original, we cannot invent it. We try to be quiet and complete. We do not warrant that every file will always leave on the first night, or that the internet will never fail.
The service is provided as is. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Our liability
We are a backup. Keep the iPhone as one copy. Do not throw away the only original because a second copy exists. To the fullest extent the law allows, PhotoCocoon is not liable for lost profits, lost data beyond the service’s own stored copy, or indirect damages. Our total liability for a claim about the service is limited to the amount you paid us for the service in the twelve months before the claim, or fifty US dollars, whichever is greater — unless the law in your place says we cannot limit that.
Nothing here limits liability that cannot be limited, including for death or personal injury caused by negligence where that rule applies, or for fraud.
9. Deletion
You may delete the account in the iPhone app: open PhotoCocoon, tap Delete account, confirm. We email you that deletion is in progress. When you confirm:
- we set the account to disabled at once;
- you cannot sign in again — you will see that the account is disabled and deleted;
- stored photos, videos, and account data are deleted within 48 hours. We email you again when that is finished.
Deleting the app from the phone, or signing out, does not delete the cloud copy. Export first. Your data. We may keep a stub so the same email cannot be reopened by mistake.
We may also disable an account that breaks these terms or the law. The same refusal to sign in applies.
10. Privacy
The Privacy Policy is part of how we handle personal data. Read it. It covers collection, storage, use, and deletion of photos, videos, and account data.
11. Changes to the service or these terms
We will change the product. We will change these terms when we have to. The current terms live at photococoon.com/terms. If a change is material, we will update the date and, where we can, tell the email on the account. Keeping the account after that date is acceptance. If you do not accept, delete the account and export first.
12. Law
These terms are governed by the laws of India, without regard to conflict-of-law rules, unless a mandatory consumer law where you live says otherwise — in which case that law applies to the extent it must. Courts in India have jurisdiction, except where you have a non-waivable right to sue where you live.
